Tax Litigation

If the federal government wants money, you have to follow tax litigation procedure to defeat them.

It starts with an appeal of an audit. This is administrative law, at its core: an administrative arm of the government, providing its own judge to hear its own dispute. Sometimes this is just a railroad. Sometimes it is meaningful and results in justice, whether it is a win or a compromise.

From this point, you can pay the tax and sue the federal government for a refund.

Or, if you cannot pay the tax, or the consequences of payment are severe, you can sue in tax court. If you win, no payment will ever be made. If you lose, you have two choices. Do your best to pay the tax, even over time, or make an appeal to the United States Court of Appeals for the Fifth Circuit.

You may have to make one or more steps along this trail; as a CPA and a tax litigation attorney, I have made them all and that is your advantage. I have made them well enough that I am known at both the IRS and Department of Justice levels. Frequently, my cases are fast-tracked to look for settlement.
