Austin Contract Litigation Attorney

Breach of Contract

Texas Contract Litigation Lawyer

Whatever you thought the agreement was, you and the other party are now at odds. You want to avoid the expense and uncertain outcome of a lawsuit. On the other hand, you don't want to give in or give up too much in settling the dispute.

Contact the law office of John McDuff at 512.457.1177 to determine your best course of action. I have resolved breach of contract cases for 20 years in business litigation, including disputes over multi-million-dollar deals. I represent businesses in Austin and Central Texas in the full gamut of contract situations:

  • Contracts with customers for goods or services
  • Business-to-business disputes (vendors and suppliers)
  • Sale or purchase of a business or assets
  • Sale of stock or ownership interest
  • Real estate transactions
  • Joint ventures and investor agreements
  • Lending agreements

Breaking It Down — What Happened and What Next?

Perhaps one party has found the deal unprofitable and refuses to pay or perform. The ambiguity of a poorly drafted contract may bring matters to a head. Was there an "unwritten agreement," implied warranty or misrepresentation? Sometimes the dispute escalates to allegations of fraud.

I can determine how many causes of action you can plausibly bring, against which parties, and available remedies,  from damages to injunctive relief. Conversely, I can assess your exposure and serve as your lawyer if you are the one being sued for breach of contract.

I enjoy trying a challenging case, but it must make business sense to file suit. I project costs and likelihood of prevailing in litigation so that clients can make an informed decision when going that route. And I first thoroughly explore opportunities to resolve contract disputes out of court, including negotiation, mediation or arbitration. If a continuing business relationship is critical, the solution may be a new binding agreement.

Commercial Collections - I handle collections involving at least $50,000 when a lawsuit is the only recourse to recoup on a large debt. I can also represent borrowers when a lender calls in the loan over a failing venture. These matters typically involve more issues that just the lending contract.

Contact my Austin office to discuss strategies in your breach of contract case. I return calls and e-mails promptly, if not immediately.
